Fayose yet to be served with Aisha's court papers - Ozekhome

– Mike Ozekhome (SAN) says Governor Ayodele Fayose has not been served with Aisha Buhari’s court papers – Questions whether the wife of President Muhammadu Buhari has the right to sue a governor who has immunity under section 308 of the 1999 constitution Aisha Buhari on Wednesday July 20, sued Governor Ayo Fayose for claiming she was involved in the Halliburton scandal. Counsel to Governor Ayodele Fayose of Ekiti state, Mike Ozekhome (SAN), says he is eagerly waiting to be served with the court papers, regarding the suit filed by wife the of President Muhammadu Buhari, Aisha against his client. Ozekhome (SAN), who told The Punch that that his client had not been served with Aisha’s court papers, questioned whether the first lady had the right to sue a governor who had immunity under section 308 of the 1999 constitution. He said: “ We have not been served Mrs. Aisha Buhari’s writ against Governor Fayose. We are waiting for this legally and jurisprudentially titillating and ground-breaking suit that will open up new vistas and rip open the yet undiscovered entrails of Section 308 of the 1999 Constitution, which grants immunity to the President, Vice-President, governors and deputy governors.” The media had reported that Aisha dragged Fayose to court for repeatedly alleging that she was one of those indicted for involvement in the multi-million dollars Halliburton scandal. The president’s wife had on many occasions denied involvement in the Halliburton scam with a threat to sue Fayose if he did not stop dragging her into a fraud she claimto to know nothing about. She had sent a letter to the embattled Ekiti state governor through her legal team asking him to retract his statement within five days or face the law. However, the governor refused to retract his statement and insisted he was right about his allegation. According to Premium Times, a court order was issued on Wednesday, July 20 although it is not known if the governor will appear in court considering he has immunity against criminal prosecution as a sitting governor. In the ex-parte motion Mrs. Buhari prayed the Federal High Court, Abuja division, to grant her reliefs to issue writ of summons against Mr. Fayose and his media advisers, Idowu Adelusi and Lere Olayinka. Meanwhile, the All Progressives Congress in Ekiti state has dismissed claims by Governor Ayo Fayose that he has been discharged and acquitted by the Federal High Court over an alleged N1.3bn poultry project. According to The Punch, the state publicity secretary of the party, Taiwo Olatunbosun, in a statement on Thursday, July 21, said the fraud case instituted against Fayose by the Economic and Financial Crimes Commission (EFCC) in 2005 is still pending at the Federal High Court in Ado Ekiti.
